Refund Policy
Last updated: January 2025
1. Overview
Novaline Constructions Pty. Ltd. (ABN: 64 167 866 159, ACN: 167 866 159) is committed to customer satisfaction. This Refund Policy outlines the circumstances under which refunds may be provided for our construction services. Due to the nature of construction work, refunds are handled on a case-by-case basis.
2. Deposit Refunds
Initial deposits are generally non-refundable once work has commenced or materials have been ordered. However, deposits may be refunded in the following circumstances:
- Cancellation within 5 business days of contract signing (cooling-off period) before any work has commenced
- If we are unable to obtain necessary permits or approvals through no fault of the client
- If we determine the project cannot be completed as specified
- Mutual agreement between both parties
3. Cancellation by Client
If you wish to cancel your project after work has commenced:
- You must provide written notice of cancellation
- You will be charged for all work completed to date
- You will be charged for all materials ordered or purchased for your project
- You will be charged for any non-recoverable costs incurred (permits, design fees, etc.)
- Any remaining balance after deducting the above costs will be refunded within 14 business days
4. Cancellation by Novaline Constructions Pty. Ltd.
We reserve the right to cancel a project in the following circumstances:
- Non-payment or breach of contract by the client
- Unsafe site conditions that cannot be remedied
- Discovery of conditions that make the project unfeasible
- Client behavior that is abusive or threatening to our staff
In such cases, you will be charged for work completed and materials ordered. Any remaining balance will be refunded within 14 business days.
5. Defects and Warranty Claims
If defects in workmanship are identified during the warranty period, we will rectify the issues at no additional cost. Refunds are not provided for warranty claims; instead, we will repair or replace the defective work. This does not affect your rights under Australian Consumer Law.
6. Variations and Changes
If you request changes or variations to the original scope of work, additional charges will apply. If you decide not to proceed with approved variations, any costs already incurred for those variations are non-refundable.
7. Force Majeure
We are not liable for delays or inability to perform due to circumstances beyond our control (natural disasters, pandemics, government restrictions, etc.). In such cases, we will work with you to reschedule or adjust the project. Refunds will be assessed on a case-by-case basis.
8. Refund Processing
When a refund is approved:
- Refunds will be processed within 14 business days of approval
- Refunds will be made to the original payment method
- You will receive written confirmation of the refund amount and breakdown
- Bank processing times may vary (typically 3-5 business days)
9. Disputes
If you disagree with a refund decision, please contact us in writing to discuss the matter. We are committed to resolving disputes fairly and amicably. If we cannot reach an agreement, you may seek resolution through the Victorian Civil and Administrative Tribunal (VCAT) or other appropriate dispute resolution services.
10. Australian Consumer Law
Nothing in this Refund Policy limits your rights under Australian Consumer Law. You are entitled to a remedy if our services fail to meet consumer guarantees. For more information about your consumer rights, visit the Australian Competition and Consumer Commission (ACCC) website.
