1. Agreement to Terms
By engaging Novaline Constructions Pty. Ltd. (ABN: 64 167 866 159, ACN: 167 866 159, Licensed Builder DB-U 73946) for construction services, you agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between you (the "Client") and Novaline Constructions Pty. Ltd. (the "Company").
2. Services
Novaline Constructions Pty. Ltd. provides the following construction services in Melbourne and surrounding areas:
- New home builds (starting from $250,000)
- Complete home renovations (starting from $50,000)
- Bathroom renovations (starting from $15,000)
- Special needs modifications (starting from $5,000)
All pricing is indicative and subject to detailed quotation based on project specifications, materials, and scope of work.
3. Quotations and Contracts
All quotations are valid for 30 days from the date of issue. Quotations are estimates based on information provided and may be subject to adjustment following site inspection. A formal written contract will be provided before work commences, detailing scope, specifications, timeline, and payment terms.
4. Payment Terms
Payment terms are outlined in your individual contract. Typically, our payment structure includes:
- Initial deposit upon contract signing (typically 10-20%)
- Progress payments at agreed milestones
- Final payment upon project completion and client satisfaction
Payment methods include bank transfer and other secure payment options. Late payments may incur interest charges as specified in your contract.
5. Variations and Changes
Any changes to the agreed scope of work must be requested in writing. Variations may affect project cost and timeline. We will provide a written quote for any variations before proceeding. Additional charges apply for work outside the original scope.
6. Project Timeline
We provide estimated completion dates based on project scope. Timelines may be affected by weather, material availability, permit delays, or client-requested changes. We will communicate any delays promptly and work to minimize impact on the project schedule.
7. Permits and Approvals
We handle all necessary building permits, planning approvals, and compliance certificates required for your project. Costs for permits and approvals are typically included in the quoted price unless otherwise specified. Delays in obtaining permits are beyond our control.
8. Site Access and Conditions
The Client must provide clear and safe access to the work site. The Client is responsible for securing valuables and making arrangements for pets. We will take reasonable care to minimize disruption and maintain site cleanliness.
9. Warranties
We provide warranties on our workmanship as required by Victorian building regulations. Specific warranty terms are detailed in your contract. Warranties do not cover damage caused by misuse, neglect, or unauthorized modifications.
10. Insurance and Liability
Novaline Constructions Pty. Ltd. maintains comprehensive insurance including public liability and workers' compensation. We are not liable for pre-existing conditions, hidden defects, or damage caused by factors beyond our control. Our liability is limited to the contract value.
11. Cancellation and Termination
Either party may terminate the contract with written notice. Cancellation terms and fees are specified in your individual contract. The Client remains liable for work completed and materials ordered up to the termination date.
12. Dispute Resolution
We are committed to resolving any disputes amicably. If a dispute arises, we encourage direct communication first. If unresolved, disputes may be referred to mediation or the Victorian Civil and Administrative Tribunal (VCAT) as appropriate.
13. Governing Law
These Terms and Conditions are governed by the laws of Victoria, Australia. All parties submit to the jurisdiction of Victorian courts.
